中国银行履约保函
产品说明
中国银行应客户申请向工程承包项目中的业主或商品买卖中的买方出具的，保证申请人严格履行承包合同或供货合同的书面文件。
产品功能
保证合同义务的正常履行，保证合同标的物的质量完好；解决合同双方互不信任的问题，减少资金占压。
产品特点
1.解决交易双方互不信任的问题。银行凭借其自身良好的信誉介入交易充当担保人，为当事人提供担保，促进交易的顺利执行。
2.合同义务履行的保证。保证合约的正常履行，合同标的物的质量完好。
3.合同违约时对受害方的补偿及对违约方的惩罚。合同违约时，可通过执行保函来补偿受害方、惩罚违约方，从而避免和减少合同项下违约事项的频繁发生，避免为解决争端而引起诉讼或仲裁的麻烦及费用开支。
相关费用
履约保函收费按照我行有关规定确定的收费原则和费率办理，外币保函比照人民币保函收取各项费用。
适用客户
1.工程承包项目中的承包方；
2.物资采购项目中的供货方。
申请条件
1.具有经年检的法人营业执照或其他足以证明其经营合法性和经营范围的有效证明文件；
2.拥有贷款卡；
3.拥有开户许可证，在我行开立结算账户；
4.具有从事相应业务的资质（如对外承包资质、建筑企业施工资质等）；
5.在我行有授信额度或缴纳足额保证金或提供我行可接受的足额但保。
办理流程
一、保函申请
1.申请人填写开立保函申请书或开立保函合同；
2.申请人提交保证金或其他反担保；
3.申请人提交合同相关的基础材料；
4.申请人提交银行要求的其他相关开立保函所必需的材料。
二、保函审核及开出
1.银行对客户资格、基础交易、相关材料审查；
2.银行对客户的保证金或授信额度等抵押情况进行落实；
3.银行审核保函的书面申请及保函格式；
4.保函开出。
温馨提示
1.保函修改：根据被担保人和受益人的需要修改保函条款，如延长保函效期等。
2.保函付款/赔付：在保函效期内一旦发生受益人索赔的情况，及时通知申请人，经担保行审核索赔单据并确认与保函索赔条款的要求相符后即履行付款责任。
第2篇：中国银行 履约保函 格式

（3）本保函的规定是银行无条件的不可撤销的直接、独立义务。合同条件的修改，以及购买方所允许的时间改变或任何让步，除非此项变更能减轻或免除银行担保责任，都不能改变银行在本保函项下的义务。
（4）本保函自开立日起生效，至合同条款规定的质量保证期60日失效，但最晚不迟于■■■■■■止失效（以下简称有效期）。本保函项下的任何书面索赔通知纸质原件及索赔时需提交的本保函正本原件必须在保函有效期内银行营业时间结束前送达银行上述地址。
（5）未经银行书面同意，本保函不可转让，银行对除购买方之外的任何第三方不承担任何责任。

The Demand for Payment shall be delivered together with: a.a written statement stating that the L/G Applicant or its agent has not paid you, directly or indirectly, any amount claimed;and b.evidence to prove that the L/G Applicant has failed to refund you the advance payment in accordance with the above contract or agreement and that it is obligated to pay you the amount claimed.（三）索赔通知必须在本保函有效期内到达以下地址： 。

The rights hereunder shall not be transferred or aigned to any third party, nor shall they be offered as a security for other debts.七、本保函项下的合同或基础交易不成立、不生效、无效、被撤销、被解除，本保函无效；保函申请人基于保函项下的合同或基础交易或其他原因的抗辩，我行均有权主张。
If the contract or agreement mentioned above or the underlying transaction is null and void, becomes ineffective or invalid, or is revoked or terminated, this L/G shall become void.We are entitled to the same defenses as the L/G Applicant may have under the contract or agreement mentioned above, the underlying transaction or for any other reason.八、因本保函发生争议协商解决不成，按以下第 种方式解决：
（一）向本行所在地的人民法院起诉。
